➤ What is United nations ? - United Nations is international organization founded in 1945 after 2nd World war to Prevent further Wars & Maintain worldwide Peace.  There are 6 main Council of UN. There are many other councils of UN which are not Primary but plays important role Globally. The Human Rights Council is also one of it. The Human Right council is an Inter-Governmental Body within UN System made up of 47 states responsible for the Promotion & Protection of Human Rights Globally. This council has Right to discuss all thematic Human Rights Issues & Situations that require its Attention. Meet of this Body held at GENEVA.

      There is 1 Human Right Treaty under this council, The Human Right Treaty is a written Agreement among UN Member States. This Treaty has 9 Core which are Listed Below :

      1) Civil & Political Right

      2) Torture, Cruel, Inhuman/Degrading Treatment/Punishment

      3) Racial Discrimination

      4) Gender Discrimination

      5) Rights of person with Disabilities.

      6) Protection of all persons from Enforced Disappearance

      7) Rights of Migrants workers & Member of their Family

      8) Economic, Social & Cultural Rights

      9) Rights of Child

      These all core has their Separate Committee to handle Rights of People. These all Committees have variation in Mechanism but the Design & Operations are Very Similar. These Committees are Composed of Independent experts Elected by State Parties to the Eligible Treaty. Their task is to Monitor Implementation in States Parties of the Right set forth in the Treaties & to make Decisions on Complaints brought against the States. 


➤ Against whom can one File a Complaint ?

    If you are going to complaint against any state or its Government, the following Conditions are Required : 

   1) State (Nation) must be a part of treaty.

   2) State who have Accepted the Committees competence to Examine individual Complaints.

   If the state is not part of given 2 conditions then you can not complaint against such Nations.


➤ Who can File a Complaint ?

     1) Individual

     2) Group 

     3) NGO

     Every one can brought complaint to the UN, if the State satisfies above 2 Conditions given. In case of individual Complaint, Consent should be Attached, if one did Complaint in behalf of other Victim then victim's Consent should be Attached.

(NOTE - ACCORDING TO UN GUIDELINES, THE COMPLIANT IN UN IS LAST RESORT, THAT MEANS BEFORE YOU DO  COMPLAINT IN UN, YOU SHOULD HAVE COMPLAINT SAME IN YOUR NATION IN EVERY POSSIBLE WAYS, THEN IF YOU DON'T GET ANY RESULT THEN YOU CAN DO SUCH COMPLAINT IN UN TO BROUGHT THEIR ATTENTION. REMEMBER, COMPLAINT SHOULD BE OF VALID INJUSTICE ACCORDING TO UN).


➤  Procedure of Complaint 

      Two Group are there to Select Valid Complaints.

       1) Working Group on Communication (WGC)

       2) Working Group on Situation (WGS)

       When any individual or Group file a complaint, These are the bodies who have power to Select & to Reject the complaint. These two groups are responsible for :

        1) Examining the Written Communication (WGC)

        2) Bringing Logical patterns of Gross & reliably attested Violations of Human Rights (WGS)

 According to Resolutions 5/1's 94 Paragraph, The Chairman of WGC and the Secretariat begin the Screening of Communications or Complaint based on the Acceptable criteria set in Paragraph 85 to 88 of Resolution 5/1.

      1) Simply ill-founded & Anonymous Communications used to get Screened Out or Rejected.

      2) The Complaints which are Screened In are Transferred to the State, to get its views & Comment on The Allegations of violations against it.

      3) Both Author of Complaint & State would get update on Progress. 

      One can File complaint Through Email & also by Sending Letter, that means both way online & offline.

 

            You have to Provide Basic details like :

      1) Victim's Name

      2) Birth Date

      3) Mailing Address or Email (Depends on Your Complaint Mode)

      4) The Name of State against whom the Complaint is.

      5) Consent of Person who are Complaining or Victim's Consent

      6) Proof and if You are not providing Such proof you have to state clearly why such proof could not be Brought.

        There are two Stage of this Procedure :

      1) Admissibility - This Stage states the Formal Requirements that a Complaint must Satisfy before The Relevant Committee can Pick Complaint.

      2) Merit - The Basis of which Committee decides whether or not the Alleged Victim's Rights under a Treaty have been Violated.

➤  What are the possible outcome after Complaints got selected ?

     1) When Committee decides that the facts before it disclose Violations by the State Party of the Complainant's Rights under Treaty, Committee invite the State party to Provide information within set time frame on the Steps has taken to give effects to it's finding & Recommendations.

    2) When Committee decides that there has been no Violations of the Treaty or Complaint is not Admissible, The case would be Closed.
